These Terms of Service (“Terms”) govern your use of wandergiggles.com and our mobile app (together, the “Platform”), and outline the agreement between you (“you,” “your,” or the “User”) and Wander Giggles Inc. (“Wander Giggles,” “we,” “us,” or “our”). By accessing or using the Platform, you confirm that you understand, accept, and agree to these Terms, along with our Privacy Policy.

1. Using the Wander Giggles Platform

Wander Giggles is a curated rental and service marketplace that connects users with trusted providers offering baby gear rentals, cleaning services, and supply delivery (collectively, the “Services”). Providers list their offerings on the Platform, and Users can browse, reserve, and pay through us directly.

You must be at least the legal age of majority in your country or region to use the Platform. Certain features require account registration (“Wander Giggles Account”). You are responsible for safeguarding your login credentials and for all activity under your account. If you suspect any unauthorized access, you must notify us immediately.

We may offer the option to sign in through third-party services (like Google). By doing so, you grant us permission to access public profile data as allowed by the platform’s settings and privacy policies.

2. Provider Responsibility

We manage the Platform and facilitate bookings, but we do not own or control the equipment or services offered. Each Provider is solely responsible for the safety, availability, cleanliness, and condition of their listings. We do not guarantee any specific quality, accuracy of content, or rating reliability. Please use caution and personal judgment when booking.

If a Provider asks you to pay or communicate outside the Platform, or you are encouraged to bypass our system, this violates our Terms. Please report such behavior to support@wandergiggles.com.

3. Booking, Payment & Service Terms

3.1 Booking & Payment

Services must be requested and paid for exclusively through the Platform. The listed price at checkout includes all applicable fees and taxes. We reserve the right to update accepted payment methods at any time.

3.2 Cancellations & Refunds

• 7+ days before delivery: Full refund
• 48 hours to 7 days: 50% refund
• Less than 48 hours before: No refund
• Provider cancellation: Full refund

3.3 Delivery & Communication

Delivery and pickup are coordinated directly via email, text, or phone. You are responsible for providing complete and accurate information.

3.4 Add-Ons & Extensions

Want more gear or more time? Request additional services or extensions through the Platform. Additional charges will apply at the rates listed.

3.5 Equipment Condition & Use

You agree to:

• Inspect all items upon receipt
• Use items in accordance with manufacturer instructions
• Return items in good condition (normal wear excluded)

Smoking near gear, food or drink in certain items, or returning unsanitary items (e.g., soiled, exposed to disease, strong odors) may result in additional cleaning or damage charges.

3.6 Damage & Replacement

• Minor damage may incur a repair fee
• Lost, stolen, or destroyed gear may incur a replacement cost equal to its fair market value plus shipping

3.7 Special Notes for Car Seats

• We don’t install car seats
• Car seats involved in any accident must be replaced
• Never clean car seats with bleach, peroxide, steam, or other harsh chemicals; only use manufacturer-approved methods

4. Cleaning & Supply Services

4.1 Cleaning Terms

• We don’t clean recalled, expired, or non-functional equipment
• You acknowledge that cleaning may reduce flame retardant effectiveness
• You are responsible for verifying reassembly and installation after cleaning

If you’re dissatisfied, contact us within 48 hours to request a complimentary re-clean.

4.2 Damage to Your Rented Gear

We are not liable for cleaning-related damage unless reported within 48 hours. In such cases:

• Minor damage: repair or resale value compensation
• Major damage: replacement of the equivalent item

5. Ratings and Reviews

Users may post reviews and star ratings to share their experiences. We do not verify or edit reviews for accuracy, but we reserve the right to remove content that violates these Terms.

6. Ownership and License

All content on the Platform — text, images, logos, software — is owned or licensed by Wander Giggles. You are granted a limited, non-exclusive license to use the Platform for personal, non-commercial purposes only. Any misuse, copying, or reverse-engineering is strictly prohibited.

7. Platform Use Restrictions

You agree not to:

• Circumvent payment through the Platform
• Misrepresent, spam, or harass others
• Post or share offensive, discriminatory, or false content
• Use bots, scrapers, or reverse-engineering tools
• Damage, hack, or interrupt Platform operations
• Use Wander Giggles trademarks or content without permission

We reserve the right to remove content, suspend accounts, or take legal action if misuse is detected.

8. Account Termination

We may suspend or permanently terminate your access if:

• You violate these Terms
• You engage in fraud, abuse, or harassment
• Your use of the Platform puts others at risk

You may not register a new account if your existing one is terminated without our prior written permission.

9. Disclaimers

Wander Giggles provides the Platform “as-is.” We make no warranties about the Services, gear condition, or Providers’ performance. Use of rented gear (e.g., inflatables, play structures, car seats) carries inherent risks, and you assume all responsibility.

We are not liable for:

• Accidents or injuries related to rented gear
• Damaged personal property
• Miscommunications between you and any third-party

10. Limitation of Liability

To the fullest extent permitted by law, Wander Giggles’ total liability for any claim related to these Terms or use of the Platform is limited to the greater of the total amount you paid through the Platform in the last 12 months.

We are not responsible for indirect, incidental, punitive, or consequential damages, including loss of profits, data, or reputation.

11. Indemnity

You agree to defend, indemnify, and hold Wander Giggles and its team harmless from any claims, losses, damages, or legal expenses arising from:

• Your use or misuse of the Platform
• Breach of these Terms or applicable laws
• Damage or harm caused to Providers, Users, or third parties

12. Legal Terms

12.1 Governing Law

These Terms are governed by the laws of the Kingdom of Saudi Arabia (KSA).

12.2 Dispute Resolution

We aim to resolve issues amicably. If we can’t, you agree to:

• Attempt non-binding mediation
• Submit unresolved claims to binding arbitration (not court)
• Waive class actions or group arbitration

Disputes involving intellectual property or urgent injunctive relief may be brought before courts in Riyadh, KSA.

13. Feedback & Ownership

We welcome your ideas. By submitting feedback or suggestions, you grant Wander Giggles the right to use and integrate them into our products and services without restriction or compensation.

14. Miscellaneous

• No Waiver: Our failure to enforce any right doesn’t waive it.
• Severability: If one part is invalid, the rest still applies.
• No Assignment: You may not transfer your rights under these Terms without written consent.
• No Third-Party Beneficiaries: Except our affiliates, no one else can enforce these Terms.
