This Liability Waiver (“Waiver”) applies to the use of baby and children’s equipment rented through the Wander Giggles Platforms.

This Waiver should be read together with the Wander Giggles Terms of Service, Rental Agreement, and applicable policies.

By booking or using rented equipment, you (“Renter”, “you”, or “your”) acknowledge and agree to the following, to the extent permitted by applicable law.

1. Acknowledgement of Risk

The Renter understands that the use of baby and children’s equipment may involve inherent risks, including risks of:

• Falls or tipping;
• Improper use or installation;
• Failure to follow safety instructions;
• Failure to use safety restraints;
• Equipment misuse or malfunction; and
• Accidental injury or property damage.

The Renter voluntarily accepts responsibility for using the equipment carefully and appropriately.

2. Safe Use and Supervision

The Renter agrees to:

• Follow all manufacturer instructions and safety warnings.
• Use equipment only for its intended purpose.
• Ensure the equipment is suitable for the child’s age, size, weight, and needs.
• Properly install and adjust equipment where required.
• Use applicable safety restraints.
• Provide appropriate adult supervision.

The Renter acknowledges that rented equipment does not replace adult supervision.

3. Car Seats and Vehicle Safety Equipment

Where a car seat or booster seat is rented, the Renter acknowledges that safe use depends on proper selection, installation, and use.

The Renter is responsible for:

• Selecting an appropriate car seat for the child.
• Confirming compatibility with the vehicle.
• Correctly installing the car seat.
• Following the manufacturer’s instructions.
• Properly securing the child before every journey.
• Complying with applicable traffic and child safety laws.

Wander Giggles does not install car seats unless a specific installation service is expressly offered and confirmed.

The Renter agrees not to use a car seat that appears damaged, defective, or unsafe and will immediately report any safety concern to Wander Giggles.

4. Responsibility for Misuse

The Renter acknowledges that they are responsible for risks and consequences arising from their own:

• Misuse of equipment;
• Failure to follow manufacturer instructions;
• Incorrect installation;
• Failure to properly secure a child;
• Failure to supervise a child; or
• Use of equipment for an unintended purpose.

5. Marketplace Relationship

The Renter acknowledges that Wander Giggles operates a marketplace that connects Users with independent Providers in association with Wander Giggles.

Providers are responsible for the equipment they list on the Platform, including its availability, condition, and applicable maintenance and safety requirements, subject to the Wander Giggles Terms of Service and Provider Agreement.

Wander Giggles facilitates the marketplace and booking process but does not manufacture the equipment listed on the Platform.

6. Release and Limitation

To the maximum extent permitted by applicable law, the Renter agrees not to hold Wander Giggles responsible for losses, injuries, or damages arising solely from the Renter’s misuse of equipment, failure to follow instructions, incorrect installation, failure to supervise, or use outside the intended purpose.

Nothing in this Waiver excludes or limits any liability that cannot legally be excluded or limited under applicable law.

7. Reporting Safety Concerns

The Renter agrees to stop using any rented equipment that they reasonably believe is unsafe, damaged, or defective and to notify Wander Giggles as soon as possible.

Wander Giggles may request photographs, videos, or other information to investigate reported safety concerns or incidents.

8. Acknowledgement and Acceptance

By accepting this Waiver, the Renter confirms that they:

• Have read and understood this Waiver.
• Understand the potential risks associated with using children’s equipment.
• Agree to follow manufacturer instructions and applicable safety requirements.
• Accept responsibility for their own actions and the proper use of rented equipment.
• Understand that children must be appropriately supervised.
• Understand that Wander Giggles operates as a marketplace platform.

This Waiver applies only to the extent permitted by applicable law.
